Payment |
| Unless otherwise agreed in writing, payment for products and service
supplied shall be made in full by the Customer to Albatross Computers,
within the approved term as advised by Albatross Computers, or in the
absence of a term approved by Albatross Computers within (7) days from
date of invoice. Any invoice for goods will also require the payment of

Default in Payment |
| If the Customer defaults in payment to Albatross Computers, then; All monies owing by the Customer to Albatross Computers shall become due and payable forthwith without demand; and Albatross Computers may at its sole discretion suspend the provision of credit to the Customer until all amounts owing by the Customer have been paid in full. If the Customer fails to make payment to Albatross Computers when due, Albatross Computers may charge a late payment fee of $8.80. Albatross Computers may also charge interest on the amount(s) due and owing, from the date it becomes due until the date of payment at the annual percentage rate equivalent to the rate prescribed from time to time pursuant to Section 94 of the Supreme Court Act of New South Wales, 1970 or any subsequent amending legislation. |
Returns |
| Albatross Computers will not accept return of goods unless prior written approval has been given by Albatross Computers in relation to same. Where such goods are returned those goods may be subject to a 20% restocking charge together with the cost of freight, which shall be at the expense of the Customer. No such returns can be accepted unless the invoice number is quoted prior to such return. |
Liability |
| Albatross Computers accepts no responsibility or liability for the loss of the use of products, loss of time, inconvenience or any other loss or damage, direct or consequential or otherwise arising out of or related in any way to a defect in material or workmanship of the products or attributable to any conduct, negligence, fault or default of Albatross Computers |
Applicable Law |
| Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if goods fail to be of acceptable quality and the failure does not amount to a major failure. |
Provision of Credit |
| The provision of credit/or the continued provision by Albatross Computers
to the Customer from time to time, shall be at the absolute discretion
of Albatross Computers. Albatross Computers may at its absolute discretion extend credit to the Customer or May at any time vary or cancel the credit facility available to the Customer Extend and/or continue to extend credit to the Customer subject to the provision of security in a form acceptable to Albatross Computers. |
